DEFINITIONS
By content, in the sense of these terms and conditions, the following will be understood:
- Any of the information found on the SITE that can be visited, viewed or otherwise accessed using a digital device;
- the content of any e-mail sent by Artwall.ro to its CUSTOMERS by electronic means and/or any other available means of communication;
- any information transmitted by any means, by an employee of Artwall.ro, to any of the CLIENTS of the Site, according to the contact information, specified or not by them;
- information related to the products, services and/or rates applied by Artwall.ro in a certain period;
- information related to the products, services and/or rates charged by a third party with whom Artwall.ro has concluded partnership contracts, during a certain period;
- data relating to Artwall.ro, or other privileged data thereof.
CAMPAIGN – the act of exhibiting for commercial purposes, exclusively electronically and only through the website, a finite number of products with a limited and predefined stock, for a limited period of time established by Artwall.ro.
SERVICE – electronic commerce service, in the sense of providing the possibility
CLIENT to contract products and/or services using exclusively electronic means.
MEMBER – The natural person who obtains access to the CONTENT, through any means of communication made available by Artwall.ro (electronic, telephone, etc.), based on a user agreement existing between Artwall.ro and it and which requires creation and use of an ACCOUNT.
ACCOUNT – the set consisting of an e-mail address and a password that allow only one
MEMBER access to restricted areas of the SITE through which access is made to
SERVICE/contracting.
CLIENT – The natural person who has the status of MEMBER of Artwall.ro and/or the person who has placed at least one order on the site.
DOCUMENT – these Terms and Conditions
Distance CONTRACT – according to the definition contained in O.G. 34/2014 any contract concluded between the professional and the consumer within an organized distance sales or service provision system, without the simultaneous physical presence of the professional and the consumer, with the exclusive use of one or more means of distance communication, up to and including the moment when the contract is concluded;
TRANSACTION – collection or reimbursement of an amount resulting from the sale or promise of sale of a product / service by Artwall.ro to the Client, by using the services of the card processor agreed by Artwall.ro, regardless of the method of delivery;
TRADEMARK RIGHTS
The names Artwall, Artwall.ro and the Artwall logo are trademarks registered by SC ARTWALL GALLERY S.R.L. The reproduction, imitation, use or application of these brands without obtaining prior authorization from SC ARTWALL GALLERY S.R.L. constitutes a crime punishable according to the laws in force.
COPYRIGHT
The entire content of the Artwall.ro website – images, texts, graphics, symbols, graphic elements, scripts, programs and other data – is the property of Artwall.ro and its suppliers and is protected by the Copyright Law and by the laws regarding intellectual and industrial property. The use without the consent of Artwall.ro of any of the elements listed above is punishable according to the laws in force.
The Member or Client may copy, transfer and/or use content only for personal or non-commercial purposes, only if they do not conflict with the site’s terms and conditions
No content transmitted to the Member or Client, by any means of communication (electronic, telephone, etc.) or acquired by him by accessing, visiting and/or viewing does not constitute a contractual obligation on the part of Artwall.ro and/or the employee Artwall.ro which mediated the transfer of content, if it exists, in relation to that content.
Any use of the Content for purposes other than those expressly permitted by the document or the user agreement that accompanies it, if it exists, is prohibited.

By using the contact form or the service present on the website, the Member or Client allows Artwall.ro to contact him by any available means, including electronic means, respectively electronic mail (e-mail, SMS).
Completely or partially completing the contact form and sending it does not in any way represent a commitment on the part of Artwall.ro to contact the Member or the Client.
Artwall.ro reserves the right not to respond to requests of any nature, which are not related to the products/services present on the site or to a contract concluded with a Member or Client, received by any means of communication (electronic, call by phone, SMS, etc).
PRIVACY POLICY OF PERSONAL DATA
This Policy establishes Artwall.ro’s policy regarding:
1. The processing (including the collection, storage, use, disclosure of information
and transfer) of the personal data of Customers and Members;
2. The requirements for obtaining consent from the persons concerned.
3. The policy defines how personal data
(as defined below) should be processed and sets out additional requirements for the
processing of special categories of personal data (e.g. data with
sensitive character – also defined below).
Basic definitions
What is personal data?
Personal data includes any information by which a person can be identified, directly or indirectly, for example: name, email and other contact information, position, psychometric test results, managerial information. It may also include data that is more difficult to attribute to a person, such as an identification code, IP address, or an online identifier (username, nick, etc.).
What are the special categories of data?
“Special categories of data” are personal data related to any of the following types of data: racial and ethnic origin; Political Views; religious, philosophical or similar beliefs; union membership; mental or physical health; genetic data; biometric data used for the unique identification of a natural person (including photos used for identification); sexual life or orientation; crimes (actual or alleged) or litigation for any crime. Romania also has special rules for the processing of unique national identifiers (personal numerical
code). (For clarity, „special categories of data” were, in the past, known as, and are sometimes called, „sensitive personal data”.)
What is processing?
„Processing” has a very broad meaning, and includes almost any activity that involves, in any way, personal data, including obtaining, viewing, recording, storing and disclosing such data.
What is a data subject?
For the purpose of this Policy, a „data subject” is a living person about whom Artwall processes personal data. All data subjects have rights over their personal data.
What is consent?
„Consent” of a data subject means any freely given, specific, informed and clear indication of the data subject’s desire by which he consents to the processing of personal data. This can be provided by a statement given by the data subject, or by a tick or opt-in solution.
In particular, consent cannot be implied by actions or behaviour. You can read more about data subject consent in section 9.
Artwall.ro collects personal data on the pages of its Sites, only with the voluntary consent of the Member or the Client, for the following purposes:
- validation, dispatch and invoicing of orders to him;
- resolving cancellations or problems of any kind related to an order or a contract, to the services or products purchased by him;
- to ensure his access to the service;
- contacting him, at his voluntary request;
- contacting him, in matters of Customer Relations;
By creating the Account, each Member or Client has expressed their consent for Artwall.ro to collect and administer their personal data, under the conditions and in compliance with the provisions of Law 677/2001.
Any Member or Client has the right to obtain from Artwall.ro, through a written, signed and dated request, free of charge:
- confirmation of the fact that the data concerning him are or are not processed by him
- as the case may be, rectifying, updating, blocking or deleting data whose processing is not in accordance with the law, especially incomplete or inaccurate data;
- as the case may be, the transformation into anonymous data of data whose processing is not in accordance with the law;
- notification to third parties to whom the data of any operation carried out according to letter b) or c), if this notification does not prove impossible or does not involve an effort disproportionate to the legitimate interest that could be harmed. By virtue of voluntary registration on the Artwall.ro website or accessing (ordering) Artwall.ro products/services, the Member or Client agrees with (gives his/her consent to) the processing of personal data by Artwall.ro in its own system computer, both manually and automatically, for the purposes stated in point 6.1, in accordance with art. 5 paragraph 1 of Law no. 677/2001 regarding the protection and processing of personal data. If the Member or Client does not agree with the processing of his personal data by Artwall.ro, he has the right not to use the website and not to provide Artwall.ro with personal data.
Any Member or Client has the right to object at any time, for well-founded and legitimate reasons related to his particular situation, by sending to Artwall.ro a written request, dated and signed as data that concerns him to be the subject of processing, except in cases where there are legal provisions to the contrary. In case of justified opposition, the processing can no longer concern the data in question.
Any Member or Client has the right to object at any time, free of charge and without any justification, by sending to Artwall.ro a written request, dated and signed, that the data it concerns be processed for direct marketing purposes, on behalf of the operator or a third party, or to be disclosed to third parties for such a purpose.
The client has the right to object to the collection of his personal data and to request their deletion, thus revoking his consent given for the document, and thus renouncing any implicit right specified therein and without any subsequent obligation of any party to the other or without any party being able to claim damages to the other.
To exercise the rights according to art. 6.2, the Client or Member will contact Artwall.ro, by any means of written communication.
If the Customer opts for online payment of the order value, VISA and MasterCard cards, issued by banking institutions, are accepted, provided that the issuing banks have activated them for online payment.
Artwall.ro does not request or store any information regarding the Customer’s bank card or cards, these being processed directly on the servers of the online payment service provider.
The Artwall.ro privacy policy refers only to the data provided voluntarily by the Customer or Member exclusively on the site. Artwall.ro is not responsible for the privacy policy practiced by any other third party that can be reached through links, regardless of their nature, outside the site.
Artwall.ro undertakes to use the collected data of the Client/Member only in accordance with the stated purposes and not to publish, sell, rent, license, transfer, etc. the database containing information related to the personal or special data of the Member/Client of any third party not involved in the fulfillment of the declared purposes.
Exception from the provisions of art. 6.7 will make the situation in which the transfer / accessing / viewing / etc. is required by the competent bodies in the cases provided by the regulations in force on the date of the occurrence of the event.
The bank card processor(s) approved by Artwall.ro have(have) the right to access/view any type of data/documents, generated following an order issued, canceled orders, contract, canceled contract or of an honored contract, to investigate any Transaction, if it exists.
Artwall.ro guarantees that the personal data of a client/user/member, collected through the contact form, will be used only until solving the problem communicated by him, after which they will become exclusively statistical data.
Artwall.ro is not responsible for failures that may endanger the security of the server on which the database that contains this personal data is hosted.

Under these conditions, the price accepted by Artwall.ro after the generation of the invoice is always considered as the final price. Except for the situation in which, following a conversation with the Client, another resolution is reached. For any such problem, Artwall.ro will notify the Client through any of the contact methods provided by him.
Product availability is displayed in real time. Availability may change at any time during order processing.
Customized products are produced on-demand, after the customer has placed an order. These products cannot be returned, based on the existing legal regulations
in Romania.
Order online
- The customer can place an order on the Artwall.ro website after creating an account or place an order without an account, as a visitor. The customer can cancel the created account at any time, communicating this via email to the address hello@artwall.ro.
- The customer can place orders for products sold at a given time, exclusively on the website, by adding the desired product/products to the shopping cart, then completing the order by paying through one of the expressly indicated methods. Once added to the shopping cart, a product is available for purchase as long as it is in stock. Adding a product to the shopping cart, without completing the order, does not entail
the automatic reservation of that product. - By completing the order, the Customer agrees that all the data provided by him, necessary for the purchase process, are correct, complete and true on the date of placing the order, named in this document and the order issued.
- By completing the order, the Client agrees that Artwall.ro can contact him, by any means available / agreed by Artwall.ro and provided for in this Document, in any situation in which it is necessary to contact the Client. Artwall.ro can unilaterally cancel the order made by the Customer, following a prior notification addressed to the Customer, without any subsequent obligation of either party to the other or without any party being able to claim damages from the other in the following cases:
1- non-acceptance by the issuing bank of the Client’s card, of the transaction, in the case of online payments;
2- invalidation of the transaction by the card processor approved by
Artwall.ro;
3- the data provided by the Client on the site are incomplete or incorrect;
4- the Client’s activity on the site may and/or cause damages of any kind,
or in any way harm Artwall.ro and/or its partners ;
5- making more than one consecutive failed delivery attempt; - The customer can cancel an order
- In the event that the Customer renounces within the legal term of withdrawal from the contract, an order placed, for which the payment was made by bank card and in which the bank issuing the Customer’s card transferred the amounts paid to the Artwall.ro account, this amount will be returned by Artwall.ro in a maximum of 30 calendar days from the date on which the latter became aware of this fact, to the IBAN account indicated in writing by the Client.
- In the event that a product ordered by the Customer, having previously made a
payment with a bank card, cannot be delivered by Artwall.ro, due to its own fault or due to the
fault of a third party, Artwall .ro will inform the client about this fact and will submit
all legal diligence for the recovery of the amount and its return to the
Client’s account, within 14 working days from the recovery of this amount, if

which, by their nature, cannot be returned or which can degrade or damage< br />fast; - contracts for the supply of audio, video or computer programs, if these recordings or computer programs have been unsealed by the consumer;
- contracts for the supply of newspapers, periodicals, store journals;
- betting or lottery service contracts;
- The customer undertakes to notify Artwall.ro of his intention to return the
purchased products, by any means of written communication (e-mail/fax/etc) within
maximum 30 calendar days from receiving the products and/or services. - The customer who notified Artwall.ro is responsible for ensuring that
the products he referred to will be returned within a maximum of 30 calendar days,
otherwise, Artwall.ro, considering the unfounded/invalid request may refuse
the return. - In the case of refunding the value of the product, this will be done within 14
calendar days at the latest from the confirmation of the return, and the refund will be made only to
the customer’s bank account, regardless of the method of payment from order
placed. - In the case of replacing the product, the replacement will be done under the conditions and limits of a
normal order. - The consideration for additional services including, but not limited to
transportation of the products, paid by the customer, is not reimbursed. - In all cases, the return/re-shipment costs will be borne by the
customer, except for the situations presented above, as well as in the case of lack of
conformity, a situation in which Artwall.ro will bear the value of the transport. - Products purchased as a package are accepted for return only in their original form,
that is, all products contained in the returned package must be intact. - Custom Products.

Order online
RETURN POLICY
The customer has the right to notify Artwall.ro in writing that he is canceling the purchase, with
respecting the deadline of 30 calendar days from receiving the product. According to
the provisions of OG 34/2014, the customer has the right to return within 14 days, however,
the Artwall site offers an additional return period.
If the customer is dissatisfied with the products purchased from the Artwall.ro website and
wants to cancel the purchase and implicitly have the amount paid returned, he can
apply for the product return procedure in maximum 30 calendar days,
according to the provisions of UG no. 34/2014, regarding consumer protection when concluding and
executing distance contracts. The cost of the transport is not returned.
The period of 30 calendar days provided for the exercise of this right begins
to run:
1. for products, from the date of their receipt by the consumer;
2. for services, from the day of conclusion of the contract;
The right of return within 30 calendar days is addressed only to customers who have
purchased products online from the website www.artwall.ro.
The client has the right to unilaterally terminate the distance contract, within 30
calendar days, without penalties and without citing any reason.
According to UG no. 34/2014 the consumer is responsible for paying the expenses
related to the round-trip transportation of the products.
The right to cancel the purchase does not apply to legal entities, but
the Artwall team is open to requests from legal entities to
change or return products in certain situations. For more details, you can

A product can be returned/exchanged only once.
Reimbursement of the amounts will be made no later than 14 days from the date of termination
of the contract by the consumer, in an IBAN account provided by the client. Any
reimbursement of the amount paid, regardless of the payment method chosen by the customer at the
time of placing the order, is made by bank transfer to an IBAN account.
According to the provisions of UG no. 34/2014, the consumer cannot unilaterally denounce
the following types of contracts, except in cases where the parties (consumer and
merchant) have agreed otherwise:

Products with physical changes, bumps,
scratches, etc. are not accepted for return.
Products can only be returned by the same delivery method by which they were
sent. The products will be returned to the address mentioned in the Contact section.
Caution!!!
All products that are personalized with inscriptions, texts or colors provided by the
customer cannot be returned, according to the law, because they are made to order and cannot be
resold.
Defective products received
In the event that you receive a non-functional product or one that has manufacturing defects, it will be replaced, provided you notify us by email within 48 hours
of receiving the product. The customer has the right to request the return of the value of the
product or its replacement with a compatible one. If the Artwall.ro site cannot replace
the product with a compliant one, the value of the product will be returned. The return
of the product is done at the expense of Artwall.ro.
To return a product, please email us the order number,
the name of the products you want to return and the address from which the courier will
pick up the order. We will answer you by e-mail within 3 working days, with
return instructions.
Products must be returned in the original or equivalent packaging. The Artwall.ro site reserves the right not to accept products that are damaged due to insufficient packaging. Please use a protective box to
prevent damage during transit.
Products for which returns are not accepted are:
Change or modification of products
In rare cases, depending on customer dissatisfaction, we accept the modification of
products.
For products received back for which modifications or changes have been requested and for
which are found to be damaged, scratched or bent – which means that they
cannot be resold – a fee of return from the customer of 30% of the price
these, as well as the shipping fee for shipping the new products.
Parcel returned without prior notice
In the event that a package that was sent by Artwall is not accepted by the recipient without a given reason and without prior notice through any contact method: telephone, email, chat support, etc. the following measures will be ordered:

for the damages caused by the use in other ways than those recommended of the
products purchased through this site. The Artwall.ro website and the
related materials are used „as is” and „as available” without guarantees of any kind.
Artwall.ro cannot be held responsible in any way to any Member/Client
who uses the Site or its Content, other than within the limits of the articles constituting the
Terms and Conditions. p>
Those who access/visit the site can make comments and any other communications; to
transmit suggestions, ideas, questions or other information, as long as their content
is not illegal, obscene, threatening, defamatory, does not in any way disturb the private life
of other people, does not violate intellectual property rights, does not contain viruses,
texts regarding various promotional campaigns, chain letters, mass emails or
any other form of spam. Users who will use a false e-mail address or will
send electronic messages or any other communications in the name of another
physical or legal person or in the name of any other entity will be sanctioned accordingly
with the laws in force. SC ARTWALL GALLERY S.R.L. has the right to delete any
such content identified on the site.
SC ARTWALL GALLERY S.R.L. will not bear the responsibility nor will it be
obliged to pay any kind of compensation for any kind of damage caused by such
communications. In case of sending or displaying some materials/documents, it is considered that
the user confers to SC ARTWALL GALLERY S.R.L. and its affiliates/associates
the non-exclusive, unlimited, free, irrevocable and retransmissible right to use,
reproduce, modify, adapt, publish, translate, create derivative works, as well as the right
to distribute, to present these contents anywhere in the world, by any means.
COMMUNICATIONS AND COMPLAINTS

Any conflict arising between SC ARTWALL GALLERY S.R.L. and customers try to be
resolved amicably by understanding between the two parties. SC ARTWALL
GALLERY S.R.L. undertakes to return to the customer the sums collected for the
returned products, within a maximum of 14 calendar days from the date of termination of the contract by
You.
If amicable conciliation is not possible, the Romanian legal provisions in this field will be applied, and the resolution of conflicts is the competence of the Romanian courts.
FORCE MAJEURE AND FORTUNED EVENT
Except for the cases in which they have not expressly provided otherwise, none of the parties
to a concluded contract, which is still in progress, will be responsible for the
non-execution on time and/or in the manner corresponding, total or partial, of any of the
obligations owed to it under the contract, if the non-execution of the respective
obligation was caused by a force majeure event.
The party or the legal representative of the party that invokes the event mentioned above,
will inform the other, immediately and completely, of its occurrence and
take any measures available to it in in order to limit the consequences
of the respective event.
The party or the legal representative of the party that invokes the event mentioned above
is exempted from this obligation only if the event prevents it
from completing it.
If within 15 days from the date of its occurrence, the respective event does not
cease, each party will have the right to notify the other party of the full
termination of this contract without any of them being able claims the other damages.
The party invoking the force majeure event must prove the impossibility
of fulfilling the obligations within 30 days from the date of occurrence of the event but within the
limits above.
LITIGATIONS
By using/visiting/viewing/etc the sites and/or any content sent by Artwall.ro to the Member/Client by accessing and/or sending by any means
(electronic, telephone, etc ), he declares that he agrees at least with the provisions
„Terms and conditions”.
Any dispute with reference to these Terms and Conditions that could arise
between the Member/Client and Artwall.ro will be resolved amicably, the parties submitting
all the necessary due diligence in this regard.< /p>
Any dispute, of any kind, that could arise between the Member and Artwall.ro or
its partners, will be resolved amicably. If this is not possible,
the conflict will be resolved by the competent court at the Artwall.ro headquarters, in
compliance with the Romanian laws in force.
If any of the above clauses is found to be void or invalid, regardless of the
cause, this clause will not affect the validity of the other clauses.
This document has been drafted and will be interpreted in accordance with Romanian legislation.
GUARANTEE OF CONFORMITY
SC ARTWALL GALLERY S.R.L. has the obligation to deliver products that are
in accordance with the sales contract, regardless of the form in which it is
concluded, verbal or written.
The products sold on the website www.artwall.ro benefit from a guarantee according to
art. 4 – point 1 lit. e from GEO 34/2014 and art. 5-18 of Law no. 449/2003, if
these are not perishable products.
All products sold by Artwall.ro benefit from warranty conditions in accordance with the legislation in force and commercial policies. The products are new and
come from sources authorized by each individual supplier.
Artwall.ro undertakes to cover the guarantee of conformity according to the law, within a period
of 2 years, calculated from the delivery of the product. In the first 6 months after the purchase,
the consumer does not have to prove the non-conformity, it is considered to have existed
on the date of purchase. For the period from 6 months to 2 years, the lack of conformity will have to be
proved by the consumer. I make an exception for products whose average duration of use
is less than 2 years, in which case the warranty term is reduced to this
duration.
FINAL PROVISIONS
Artwall.ro reserves the right to make any changes to these
provisions, as well as any changes to the site/its structure/service
as well as any content with the prior notification of the Member or To the customer, he
following to express his agreement on the changes, in no more than 3 days. In the event that
